General validity:

Each customer who orders something agrees to the following General Terms Of Buisiness by placing an order. Any terms or conditions contrary to these terms stipulated after have to be agreed to written confirmation. The failure to object shall not be demeed an approval.

Conclusion of a contract:

The sales contract between us and the ordering party shall become effective when such order is approved by us per E-Mail, telephone or fax. This approval will contain once more the designation of the ordered items and the price.

By clicking the button [SUBMIT ORDER] you sent a binding order to the content of the shopping cart to us. The confirmation of the receipt of the order you will get immediately after submitting the order. The bill of sale is completed by a seperate order confirmation or by delivery of ordered goods.

Knowledge of the trading conditions:

The text of our trading conditions will be memorized. You can read it at (this page). You can review your order data at [my Account].

Prices:

All prices are including the german VAT of currently 19% (7% for books and food). The german VAT will be deducted when we deliver to countries which are not part Of European Union. When you are already logged in and you live in one of these Non-EU-countries please notice the online-shop still shows the VAT-deducted prices. You will have to pay your local VAT to the customs. Further informations about this and perhaps further taxes or fees you could get from your local custom office.

Payment options:

The order can be paid against prepayment by bank transfer or credit card (we accept Mastercard, Visa, American Express).

If you like to pay against prepayment you can transfer the amount to our bank account. After receipt of your order we will tell you the bank account for the money bank. Your order will be delivered immediately after the cheque or the transfer dispatched.

Part delivery:

We are entitled to make part deliveries. Additional shipping costs apply only with assertive agreement.

Right to countermand:

The customer who orders something will not be bound to his declaration of agreement to the sales contract if he cancels the order within two weeks upon receipt of first delivery. It is not necessary to give reasons for concellation but it needs to be done in writing by letter, mail, fax or by sending back the goods. To meet the deadline it will be sufficient to send the cancellation of the order in time to

To become the return effective the received benefits (inclusive using advantages) have to be given back. AquaPro2000 is authorised to demand compensation if the article is in a worse condition since date of delivery. The customer can avoid demand of compensation by not using the product like an owner and by refraining everything which can reduce the value of this article.

Please notice that this return guarantee does not apply for unsealed software, newspapers, magazines and for those goods which were composed to a customers specification or which is definetly composed for your personal requirements.

Warranty:

The statuary warranty period of 24 months is valid. The warranty is limited to rectification of defects and replacement. The customer has the right to demand for redhibitory action of the contract if the retification of defects fail several times.

All positions and articles declared with an unit price are classified as individual cases and redhibitory action or reduction can only be demanded in consiederation. The liability of equipment which is older than three months is limites to the price of sale (current replcement value) which is valid at the time of redhibitory action, not the purchase price. In case of redhibitory action for some other reason the actual price will be the basis, exceeding the purchase price from the account. A liability for possible consequential damages, particularly lost profit is excluded if we did not handle with intent or gross negligence. We assume no liability for the correctness of technical information, prices or other offers published in brochure of manufacturer unless we referred to them. We reserve us technical modifications which conduces the general improvement of a product or which have no fundamental influence on the use.

If you want to assert a warrantly claim, please note:

It is necessary to attach delivery receipt or account. Rejected goods should be sent to AquaPro2000 in original packaging with an exact description of the fault. We assume no liabilty for damages which arise from incorrect handling, attendance or incorrect return or because the instruction for use was not observant. Furthermore we assume no liability for damages which arise from strange persons.

We assume no liability by the selling of used products if the salesman does not liable obligatory or something else is agreed.

Guarantee refers to the legal rules of Germany. AquaPro2000 warrants that the goods shall be exempt from fault at the time of passing of the risk. Claims arising from faults after a two year periiod are null and void. The period begins with transfer of the goods to the customer. Should, within this time period any faults in the goods arise which vastly impair their value or suitability, AquaPro2000 will immediately remedy these faults after receipt of the problem definition. If the repair fails we can send a new item or refund the full price when you send the item back or discount the prices when you keep the failure product.

Transport damage:

All deliveries will be insured. The insurance fee is part of the shipping costs. The goods have to be checked for completeness and any defects immediately on delivery. Any transport damage has to be reported within 24 hours to the respective shipping company. It is not permissible to set off any payments against the claims due to damages upon delivery.

Data protection:

As stipulated by the ata Protection Act, AquaPro2000 advise that any data from buisiness transactions is being stored. Upon customers request this data is deleted. Passing on this data to third parties is not allowed.

Final provision:

In case any of the above provisions become void, for whatever reason, the validity of the other provisions shall remain unaffected. Wherever applicable (e.g. among merchants) Herford, Germany shall be the place of juristication for any disputes araising from this contract between the customer and the company AquaPro2000.
